Claimant, James Crider, filed a claim for benefits under the Black Lung Benefits Act, 30 U.S.C. ? 901, on April 25, 1978. He was initially awarded benefits by the Department of Labor on April 4, 1979. The respondent, claimants employer, contested the award and a hearing was held before an Administrative Law Judge (ALJ). On December 22, 1980, the ALJ issued a decision and order denying benefits to claimant. The claimant appealed the case to the Benefits Review Board, and the decision was affirmed on November 30, 1982.
